Terms
The rules for using Zonto.
Terms of Service
Last updated: [DATE]
These terms are the agreement between you and [LEGAL ENTITY NAME] ("Zonto Games", "we", "us"), [a company registered in England and Wales, company number [NUMBER], registered office [ADDRESS]]. They cover your Zonto account, the Zonto website and store, the Zonto launcher, and any game we make that you sign into with Zonto (together, "Zonto").
By creating an account or buying a game, you agree to these terms. If you don't agree, don't use Zonto. We've tried to write them plainly. Nothing here takes away rights you have by law as a consumer.
1. Your account
- Age. You must be at least [13] to create an account. If you're under 18, a parent or guardian needs to agree to these terms for you, and they're responsible for purchases made on your account.
- One person, one account. Your account is for you. Don't share it, sell it, or let someone else use it.
- Keep it secure. Use a strong password and keep it private. If you sign in with Google, keeping your Google account secure is part of keeping your Zonto account secure. Tell us at [SUPPORT EMAIL] if you think someone else has got in.
- Accurate details. Give us a real email address you can access. We use it to reach you about your account and your purchases.
- Gamertags. Your gamertag is public. It can't impersonate anyone, be offensive, or infringe someone else's rights. We can change or reclaim a gamertag that breaks these rules.
2. Buying games
- Prices. Prices in the store include any VAT that applies. We price in GBP by default and may show USD or EUR. The price you pay is the one shown at checkout.
- Payment. Payments are processed by PayPal. We never see or store your card details. PayPal's own terms apply to the payment itself.
- When the contract starts. Your order is accepted when payment is confirmed. The game is then added to your library, usually straight away.
- What you're buying. When you buy a game, you get a licence to play it, not ownership of the game itself. See section 4.
- Mistakes. If we list a game at an obviously wrong price, we may cancel the order and refund you in full.
3. Cancellations and refunds
- Your 14-day right to cancel. Under UK law you normally have 14 days to cancel a purchase of digital content. For games, that right ends once the download or play starts, because at checkout you ask us to give you access straight away and confirm you understand you lose the right to cancel once it begins.
- If you haven't downloaded or played it, you can cancel within 14 days of purchase for a full refund. Email [SUPPORT EMAIL] with your order details.
- Faulty games. Under the Consumer Rights Act 2015, a game must be as described, fit for purpose and of satisfactory quality. If it isn't, and we can't fix it within a reasonable time, you're entitled to a refund in full or in part. This applies whether or not you've started playing.
- How refunds are paid. Refunds go back to the original payment method through PayPal, normally within 14 days of our agreeing to them. A refunded game is removed from your library.
- Our Refund Policy sets out the details.
4. Your licence to play
When you get a game on Zonto, whether you bought it or we granted it to you, we give you a personal, non-exclusive, non-transferable licence to download, install and play it for your own non-commercial use, for as long as you have a Zonto account in good standing.
You may not:
- copy, sell, rent, lend, sublicense or give away games or accounts;
- reverse-engineer, decompile or modify a game, the launcher or our services, except where the law allows it and you can't waive that right;
- get around download restrictions, entitlement checks or other technical protections;
- use a game or Zonto for commercial purposes without our written permission (streaming and videos are fine, see below).
Streaming and videos. You're welcome to stream, record and post videos of our games, including monetised ones, as long as you don't present them as official Zonto content.
The Zonto SDK. The developer SDK and Godot addon are open source under the MIT licence. That licence, not this section, governs your use of the SDK's code.
5. Playing fair
Don't:
- cheat, exploit bugs, or use bots, hacks or unauthorised third-party software to gain an advantage or unlock achievements;
- harass, threaten, bully or abuse other players;
- post or send anything illegal, hateful, sexually explicit, or that promotes violence or self-harm;
- spam other players, or use Zonto to advertise;
- impersonate other people, including Zonto staff;
- try to get into other people's accounts, or into parts of Zonto you're not allowed into;
- overload, disrupt or attack our services, or scrape them in bulk;
- break the law, or help anyone else break these rules.
If you find a bug or security problem, tell us at [SUPPORT EMAIL] rather than exploiting it.
6. Friends, chat and your content
Zonto has social features: friends, presence ("online", "in game"), direct messages, lobby invites and an activity feed. Anything you post or send through them is your content.
- You keep ownership of your content. You give us a licence to store, transmit and display it so the features work (for example, delivering your messages and showing your activity to your friends).
- You're responsible for what you send. Section 5 applies to all of it.
- We don't read private messages as a matter of routine. We may review content when it's reported to us, when we need to investigate a breach of these terms, or when the law requires it.
- In your profile settings you can hide your activity feed, stop friend requests, and choose whether people who aren't your friends can message you.
7. Cloud saves, achievements and progress
Some games store saves, playtime and achievements in your Zonto account so they follow you between devices. We work to keep this data safe, but we don't guarantee it will never be lost. Games that support it may also keep a local copy.
8. Signing in to games with Zonto
Games can let you sign in with your Zonto account. When you approve one, we share the account details that screen lists (such as your gamertag) with that game, and it can read and write the things it asks for (such as saves and achievements). You can ask us to revoke a game's access at any time by emailing [SUPPORT EMAIL]. A game made by someone else is covered by that developer's own terms and privacy policy, not ours.
9. Your privacy
Our Privacy Policy explains what personal data we collect, how we use it, and your rights over it. It forms part of these terms.
10. Changes to Zonto and to games
We keep improving Zonto and our games, which means things change. Updates can add, change or remove features. Some games need to be updated before you can keep playing them. We won't make a change that stops a game you paid for from working as described, unless the change is needed for legal or security reasons, and if we do, we'll tell you and, where appropriate, offer a refund.
Zonto relies on online services. We aim to keep them running but can't promise they'll always be available or free of errors. We'll try to give you notice of planned downtime.
If we stop offering a game or shut down Zonto, we'll give you at least [90] days' notice, and we'll try to give you a way to keep playing games you paid for (for example, a build that runs without our servers).
11. Suspending or closing accounts
- You can close your account at any time from your profile. This permanently deletes your account, library, unlocks, saves, friends and messages. It can't be undone, and you won't be able to redownload games you bought.
- We can suspend or close your account if you seriously or repeatedly break these terms, if we have to by law, or if the account has been used for fraud. Where it's reasonable, we'll warn you first and tell you why. If we close your account for reasons that aren't your fault, we'll refund games you bought and can no longer play.
12. Our responsibility to you
- If we fail to comply with these terms, we're responsible for loss or damage you suffer that is a foreseeable result of that failure. We're not responsible for loss or damage that wasn't foreseeable.
- If a game damages a device or other digital content you own because we didn't use reasonable care and skill, we'll repair the damage or compensate you. We're not responsible for damage you could have avoided by following our advice to install an update, or by meeting the minimum system requirements.
- We only supply Zonto for domestic and private use. We're not liable for any loss of profit, business or business opportunity.
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else the law doesn't allow us to limit.
13. Changes to these terms
We may update these terms, for example because of new features or changes in the law. If a change materially affects you, we'll tell you by email or in the app at least 30 days before it takes effect. If you don't accept the new terms you can close your account, and we'll refund any game you bought within the previous [30] days that you haven't played.
14. General
- Governing law. These terms are governed by the law of England and Wales. You can bring proceedings in the courts of England and Wales, or, if you live in Scotland or Northern Ireland, in the courts where you live.
- Transferring this agreement. We may transfer our rights and obligations under these terms to another organisation, and we'll tell you if we do. You can't transfer yours.
- If part of these terms is invalid, the rest still applies.
- If we don't enforce a term straight away, we can still enforce it later.
- Nobody else has rights under these terms.
